Terms of use for FUUGO.NO Publish (Used Books)

1. Purpose and content

The purpose of the FUUGO Publish service is to give Sellers and other publishers the opportunity to self-publish works electronically. FUUGO.NO Publiser is run by Peason Consult (organisation number 927084449) and IBEC Publishing. FUUGO.NO is a Norwegian bookstore and print-on-demand online publisher that sells books and digital and downloadable books (ebooks and audiobooks) and other content that is available at all times, including works published through FUUGO.NO Publish. From time to time we will update the Terms. In the event of major changes, we will inform you directly of the update through an email to the email address you provided when registering to use FUUGO.NO Publish. In the following, the user of FUUGO.NO Publish is referred to as “Seller” and what the Seller publishes through FUUGO.NO Publish is referred to as “Used Books.” 

2. Rights

Under the conditions that follow from this agreement, FUUGO.NO grants the Seller the right to use FUUGO.NO Publish to promote their Used Books, and the Seller grants FUUGO.NO the right to distribute the Used Books on FUUGO.NO and other sites and sales channels which FUUGO.NO cooperates with 

3. Copyright

The Author /Seller retains all copyrights to the product. The Seller guarantees to have all the rights necessary to legally publish/ sell the product using FUUGO.NO Publish. FUUGO.NO is not responsible for a user’s possible infringement of third-party rights. If FUUGO.NO receives notification that the Used Book infringes the rights of a third party, FUUGO.NO has the right to immediately remove the product from FUUGO.NO. .

4. Sales commission

FUUGO.NO does not charge for the Seller’s use of FUUGO.NO Publish. FUUGO.NO takes no sales commission for used books published on FUUGO.NO. FUUGO.NO does not take part in any form in the transactions between the seller and their buyers. Every exchange of information and money is at the responsibilty of both the seller and the buyer 

5. Content and removal of content

FUUGO.NO reserves the right to reject or remove Used Books that do not meet the quality that users of FUUGO.NO can expect. In addition to this, FUUGO.NO can, without justification, reject or remove content that may seem offensive and is in conflict with FUUGO.NO’s content policy. This applies to the following: • Strongly pornographic material • Racist content • Content that attempts to harm others. In addition, the right is reserved to remove or reject content that may contain illegal information or that is otherwise contrary to Norwegian law. 

6. Processing of personal data

It is necessary to create a user profile in order to sell e-books through FUUGO.NO Publish. When you create a user profile, you can voluntarily register a range of information about yourself. Some of this information is mandatory. The required information is your name, name and address of the copyright holder of the Work, Author or company name and your e-mail address. In order to receive payment for books sold, the account number and social security number must also be registered. We use your email address to identify your user profile. In addition to this, we record whether you have accepted our terms of use. How FUUGO.NO processes personal data is regulated in FUUGO.NO’s privacy policy.

7. Privacy policy and data controller

FUUGO.NO is responsible for metadata registered in connection with sales on FUUGO.NO Publish and data registered in connection with a user profile, as well as registration of cookies and IP address. The user is responsible for other content that is registered on FUUGO.NO Publish. 
In order to offer you a FUUGO account, FUUGO will collect and process your personal data for administrative purposes. FUUGO processes and protects your personal data and other personal data when you use the services. Personal data that is collected is stored and processed in a safe and secure manner. We have established routines and measures to ensure the integrity, availability and confidentiality of the information in accordance with Section 13 of the Personal Data Act.

8. Choice of law and venue

This User Agreement is governed by Norwegian law. Any conflicts that the parties do not resolve amicably must be submitted to the Bergen district court for decision.
